1. Introduction

These Terms and Conditions (“Terms”) govern the relationship between FlyJustice OÜ (“FlyJustice”, “we”, “our”, or “us”) and any passenger or user (“you”, “your”, “customer”) who submits a claim, uploads documents, or uses our website and services.

By submitting a claim form, uploading your personal or flight data, or signing digitally through our platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy

FlyJustice assists passengers in enforcing their air passenger rights under EU Regulation (EC) No. 261/2004 and related laws. We act as your authorized representative for compensation and claim recovery in accordance with the terms below.

2. Scope of Services

FlyJustice helps passengers claim monetary compensation or reimbursement from airlines in cases of:

  • Flight delays of 3 hours or more
  • Flight cancellations
  • Denied boarding or overbooking
  • Missed connections due to delays or cancellations

Our services include:

  • Free eligibility checks
  • Preparation and submission of claims
  • Negotiation and communication with airlines or their agents
  • Escalation through legal or regulatory partners when required

FlyJustice operates independently of airlines. We are not a law firm, but we may collaborate with licensed legal representatives when legal action is required.

3. Eligibility

Our services currently apply only to flights covered by EU Regulation (EC) No. 261/2004, meaning:

  • Flights departing from an EU airport, or
  • Flights arriving in the EU on an EU-based airline.

If a claim falls outside this jurisdiction, we will inform you before proceeding.

4. Digital Authorization and Representation

By submitting your claim through our website or signing digitally, you authorize FlyJustice OÜ to act on your behalf to:

  • Contact, communicate, and negotiate with the airline regarding your claim.
  • Submit, pursue, and if necessary, escalate your compensation claim.
  • Receive payments directly from the airline or intermediary.

You authorize FlyJustice to deduct its service fee from any received compensation and transfer the remaining balance to your nominated bank account.

You confirm that:

  • The information and documents you provide are true and complete.
  • You have not authorized another company to handle the same claim.
  • You have obtained consent to represent any co-passengers included in your submission.
  • You will promptly inform FlyJustice if you receive any payment or correspondence from the airline directly.

5. No Win, No Fee Policy

Our services operate on a contingency fee model:

  • If your claim is unsuccessful, you pay nothing.
  • If your claim is successful, FlyJustice charges a service fee between 35% (no VAT applicable) of the total compensation recovered.

There are no upfront costs, hidden fees, or administrative charges. Our fee covers all efforts, correspondence, and operational costs associated with your case.

If the airline pays you directly, you are still obliged to pay FlyJustice the agreed service fee, as per the authorization given.

6. Payment Process

Once compensation is received, FlyJustice will deduct the applicable service fee and transfer the remaining amount to your provided bank details.

You are responsible for ensuring the accuracy of your payment information. FlyJustice is not liable for losses caused by incorrect or incomplete account details.

If the compensation is paid directly to you, you must inform FlyJustice and transfer the service fee upon request.

7. Customer Responsibilities

To enable efficient processing of your claim, you agree to:

  • Provide accurate, complete, and verifiable details of your flight and personal identity.
  • Respond to requests for documents or clarification promptly.
  • Avoid contacting or negotiating with the airline directly once FlyJustice has taken charge of your claim.
  • Notify us immediately if you receive any airline communication or compensation directly.

Failure to comply may delay or invalidate your claim.

8. Communication & Marketing

FlyJustice may contact you via email for case updates, document requests, or related services.

You may also receive informational or promotional content about passenger rights or travel-related services.

You can opt out of such non-essential communications at any time by emailing info@flyjustice.com.

9. Right of Withdrawal (EU Consumers)

If you are an EU consumer, you have the right to withdraw from your agreement with FlyJustice within 14 days from the date of signing or submission, provided we have not started processing your claim.

To exercise this right, email info@flyjustice.com with the following information:

“I hereby withdraw from my agreement with FlyJustice OÜ, entered on [date].”

If claim processing has begun (e.g., communication sent to the airline), withdrawal is no longer available.

10. Confidentiality

All information and documents provided to FlyJustice are treated as strictly confidential. We ensure data protection in line with GDPR (EU 2016/679).

Access to personal data is restricted to authorized personnel and trusted partners bound by confidentiality agreements.

11. Discontinuation of Claims

FlyJustice may discontinue handling a claim if:

  • The airline becomes insolvent or ceases operations.
  • New information significantly reduces the chance of success.
  • The claim is found to be invalid, fraudulent, or duplicated.
  • Legal or regulatory conditions change.

You will be notified if we discontinue your case. No fee applies in such situations.

12. Data Protection

Your data is processed only for the purpose of handling your claim, in accordance with the GDPR.

13. Liability

While FlyJustice works diligently to pursue each claim, we cannot guarantee success. We are not responsible for:

  • Airline non-compliance, insolvency, or delays.
  • Force majeure events such as strikes, weather, or air traffic restrictions.
  • Losses due to inaccurate or incomplete information from customers.

Our liability is limited to the service fee received for the particular claim.

14. Governing Law

These Terms are governed by Estonian law and relevant EU regulations, including EU Regulation 261/2004 and GDPR.

Any disputes shall be settled under the exclusive jurisdiction of Estonian courts.

15. Changes to Terms

FlyJustice may update these Terms to comply with legal changes or improve clarity. Updates will be published on our website, and material changes will be communicated by email where appropriate.
