These Terms & Conditions govern your use of Flyjustice's website and the flight compensation services provided by Flyjustice OÜ. They explain our services, your rights and responsibilities, our fees, how we process claims, and the contractual relationship created when you submit a claim through our platform. Please read these Terms carefully before using our services.

1. Introduction

Welcome to Flyjustice. These Terms & Conditions govern your use of our website and the flight compensation services provided by Flyjustice OÜ.

These Terms & Conditions ("Terms") form a legally binding agreement between Flyjustice OÜ ("Flyjustice", "we", "our", or "us") and every person who visits our website or submits a flight compensation claim through our platform ("you", "your", or "passenger").

By submitting a claim, electronically signing our authorization, uploading supporting documents, or otherwise using our services, you confirm that you have read, understood and agreed to these Terms together with our Privacy Policy, GDPR & Data Protection Commitment, and any other documents expressly incorporated into this agreement.

Flyjustice provides professional claim management and representation services for eligible passenger compensation claims under Regulation (EC) No. 261/2004 and other applicable passenger rights legislation. We are not a law firm, do not provide legal advice, and where necessary may instruct qualified legal professionals or authorised partners to pursue your claim.

These Terms apply from the moment your claim is accepted through our platform and remain effective until the claim has been successfully concluded or this agreement is otherwise terminated in accordance with these Terms.

2. Definitions

For the purpose of these Terms, the following definitions apply:

  • Flyjustice means Flyjustice OÜ, an Estonian company providing flight compensation claim management services.
  • Passenger means any natural person who uses our website or authorises Flyjustice to manage a compensation claim.
  • Claim means a request for financial compensation or reimbursement arising from applicable passenger rights legislation.
  • Compensation means any monetary amount successfully recovered from an airline or other liable party on behalf of the passenger.
  • Service Fee means the agreed success-based fee charged only after compensation has been successfully recovered.
  • No Win, No Fee means that Flyjustice charges no service fee if no compensation is recovered, unless otherwise expressly agreed in writing.
  • Authorisation means the electronic authority granted by you allowing Flyjustice to represent you throughout the claim process.
  • Electronic Signature means any digital acceptance, signature, confirmation or authentication completed through Flyjustice's platform and associated verification systems.
  • Legal Partner means an independent lawyer, law firm or authorised representative instructed by Flyjustice where legal proceedings or specialist legal assistance becomes necessary.
  • Fellow Passenger means any additional traveller included within the same claim submission.
  • Website means www.flyjustice.com together with all associated webpages and online services operated by Flyjustice.

3. Our Services

Flyjustice specialises in managing passenger compensation claims arising from flight disruption under Regulation (EC) No. 261/2004, UK261, and other applicable passenger rights legislation.

Depending on the circumstances of your claim, our services may include:

  • Reviewing eligibility.
  • Assessing supporting evidence.
  • Communicating with airlines.
  • Negotiating settlements.
  • Preparing claim documentation where appropriate.
  • Cooperating with authorised legal professionals.
  • Monitoring claim progress.
  • Recovering compensation on your behalf.
  • Transferring recovered compensation after deduction of the agreed service fee.

Flyjustice acts solely as your authorised representative for compensation claims covered by these Terms.

We do not provide independent legal advice, financial advice, tax advice or insurance services.

Where litigation or formal legal proceedings become necessary, Flyjustice may appoint qualified external legal professionals to continue pursuing your claim in accordance with applicable law.

We reserve the right to decline any claim where:

  • legal requirements are not satisfied;
  • documentation is insufficient;
  • fraud is suspected;
  • duplicate representation exists;
  • the claim has little or no reasonable prospect of success.

Declining a claim does not affect your right to pursue the matter independently.

4. Eligibility & Covered Claims

Flyjustice assists passengers whose claims fall within the scope of Regulation (EC) No. 261/2004, UK261, and other applicable passenger rights legislation, including:

  • Regulation (EC) No. 261/2004;
  • UK Air Passenger Rights and Air Travel Organisers' Licensing (Amendment) (EU Exit) Regulations 2019 ("UK261");
  • applicable national implementing legislation where relevant.

Generally, we may assist with eligible claims involving:

  • flight cancellations;
  • long delays;
  • denied boarding;
  • missed connections;
  • certain involuntary downgrades.

Coverage normally includes flights:

  • departing from an airport within the European Union;
  • departing from Iceland, Norway or Liechtenstein under the EEA Agreement;
  • departing from Switzerland where applicable;
  • arriving within the European Union on an eligible Community air carrier as defined under Article 3 of Regulation (EC) No. 261/2004.

Eligibility always depends upon the facts of each individual case, available evidence, applicable limitation periods, airline defences and relevant legislation.

Submission of a claim does not guarantee that compensation will be available or recovered.

Flyjustice currently does not manage claims falling outside our published service scope unless expressly agreed in writing.

5. Before You Use Flyjustice

Before appointing Flyjustice, you should understand that using our services is entirely voluntary. You are never required to appoint a claims management company in order to exercise your passenger rights.

Subject to your individual circumstances, you may choose to:

  • submit your claim directly to the operating airline;
  • contact the relevant National Enforcement Body (NEB) responsible for enforcing Article 16 of Regulation (EC) No. 261/2004;
  • use an approved Alternative Dispute Resolution (ADR) body established under Directive 2013/11/EU where available; or
  • appoint Flyjustice to manage and pursue your claim on your behalf.

If you authorise Flyjustice, we will assess your eligibility, manage communications with the airline, prepare supporting documentation where required, negotiate settlement opportunities, and coordinate with authorised legal partners whenever formal legal action becomes necessary.

6. Creating Your Agreement With Flyjustice

A legally binding agreement is formed when you successfully submit a claim through the Flyjustice platform and complete the required acceptance process. Acceptance may include submitting your claim, electronically signing our authorisation, uploading supporting documentation, confirming mandatory declarations, or completing any additional verification requested by Flyjustice.

By entering into this agreement, you confirm that:

  • you are at least 18 years of age, or are acting through a parent, legal guardian or authorised representative;
  • you have the legal capacity and authority to enter into this agreement;
  • all information and supporting documents provided are accurate and complete to the best of your knowledge;
  • you accept these Terms together with our Privacy Policy and GDPR & Data Protection Commitment.

Electronic signatures, electronic records and digital acceptance completed through our platform may be relied upon as evidence in accordance with Regulation (EU) No. 910/2014 (eIDAS) and other applicable legislation.

Unless terminated in accordance with these Terms, this agreement remains effective until your claim has been concluded.

7. Authorisation & Representation

By accepting these Terms, you authorise Flyjustice to represent you in connection with your flight compensation claim and to perform all reasonable activities necessary for its assessment, management and recovery.

Subject to applicable law, Flyjustice may:

  • communicate with airlines, airports and competent authorities;
  • submit claims and supporting evidence on your behalf;
  • negotiate compensation and settlement proposals;
  • request additional information where required;
  • instruct authorised lawyers or legal partners whenever legal proceedings become necessary;
  • obtain or request a Power of Attorney where required by the airline, competent authority or applicable law.

Where your claim includes Fellow Passengers, you confirm that you are authorised to submit their information or have obtained the necessary authority to do so. Claims involving minors must be submitted by a parent, legal guardian or other legally authorised representative.

If an airline contacts you directly or makes any payment relating to your claim, you must notify Flyjustice without undue delay to ensure the correct administration of your claim and any applicable Service Fees.

You may revoke your authorisation where permitted by applicable law. However, such revocation does not affect rights, obligations or services already performed before the revocation becomes effective.

8. Service Fees & No Win, No Fee

Flyjustice operates on a No Win, No Fee basis. Unless otherwise agreed in writing, you will not pay any service fee if we are unsuccessful in recovering compensation for your eligible claim.

If your claim is successful, Flyjustice will deduct the agreed Service Fee from the compensation recovered before transferring the remaining balance to you. Our current service fee is clearly published on our Service Fees page and forms part of these Terms. Where Value Added Tax (VAT) or any similar indirect tax is legally applicable, it will be applied in accordance with the laws of the relevant jurisdiction and shown transparently before any payment is made.

Our Service Fee covers the services provided by Flyjustice during the normal management of your claim, including eligibility assessment, correspondence with airlines, claim administration, negotiation, and reasonable case management activities. Unless expressly agreed in writing, no hidden fees, upfront charges, or unexpected administrative costs will be charged.

If an airline or another responsible party pays compensation directly to you after Flyjustice has commenced work on your claim, you must notify us without undue delay. Where a Service Fee is contractually payable, Flyjustice reserves the right to issue an invoice for the agreed amount, which must be paid within the period stated on the invoice.

Our No Win, No Fee commitment

  • No upfront payment is required to start your claim.
  • No Service Fee is charged if no compensation is recovered, unless otherwise agreed in writing.
  • Our current pricing is published on the Service Fees page.
  • Any applicable taxes will be applied in accordance with the law.
  • Direct payments received from an airline must be reported to Flyjustice without undue delay.

9. Payment & Compensation Distribution

Where Flyjustice successfully recovers compensation on your behalf, payment will normally be transferred to the bank account or payment method you have provided after deduction of the applicable Service Fee, where permitted under these Terms.

It is your responsibility to provide accurate payment information and to notify Flyjustice promptly of any changes before payment is processed. Flyjustice cannot be responsible for delays resulting from incorrect or incomplete payment details supplied by you.

Where compensation is received in a currency different from your preferred payment currency, any currency conversion may be carried out using the exchange rate applied by the payment provider or financial institution involved in the transaction.

If an airline makes payment directly to you after Flyjustice has accepted your claim, you must notify us without undue delay. Any outstanding Service Fee that becomes payable under these Terms remains your responsibility.

Where a payment cannot be completed due to incorrect banking information, rejected transfers or circumstances outside our reasonable control, Flyjustice will make reasonable efforts to contact you and arrange an alternative payment method.

Payment process

  • Compensation is transferred after successful recovery.
  • The agreed Service Fee is deducted before payment where applicable.
  • Accurate payment information must be maintained throughout your claim.
  • Direct airline payments must be reported promptly.
  • Currency conversion may apply where payments are made in different currencies.

10. Customer Responsibilities

To enable Flyjustice to manage your claim effectively, you agree to cooperate with us throughout the claims process and provide accurate, complete and up-to-date information whenever requested.

You are responsible for ensuring that all documents, flight details and supporting evidence submitted to Flyjustice are genuine, accurate and lawfully provided. You must not knowingly submit false, misleading, altered or fraudulent information.

During the course of your claim, you agree to notify Flyjustice without undue delay if:

  • an airline contacts you directly regarding your claim;
  • you receive any payment, settlement offer or travel voucher from the airline;
  • your contact details or banking information change;
  • another representative has been appointed or is acting on the same claim;
  • any information previously provided becomes inaccurate or incomplete.

Failure to cooperate or provide requested information may delay the assessment of your claim or prevent Flyjustice from continuing to act on your behalf where permitted by applicable law.

Your responsibilities include:

  • providing accurate and complete information;
  • submitting authentic supporting documents;
  • responding to reasonable requests for additional information;
  • informing Flyjustice of any direct communication from the airline;
  • notifying Flyjustice of any direct payment or settlement received;
  • cooperating throughout the duration of your claim.

11. Withdrawal & Cancellation Rights

If you are a consumer, you may have the right to withdraw from this agreement within 14 days without providing any reason, subject to applicable consumer protection legislation, including Directive 2011/83/EU on Consumer Rights.

Where you expressly request Flyjustice to begin providing services during the withdrawal period, you acknowledge that work on your claim may commence before the withdrawal period expires. If you later exercise your right of withdrawal after services have already begun, you may be required to pay a proportionate amount for services already performed where permitted by applicable law.

To exercise your right of withdrawal, you should notify Flyjustice by sending a clear written statement of your decision before the withdrawal period expires using the contact details provided on our Contact Us page.

The exercise of your withdrawal rights does not affect any statutory rights available to you under applicable consumer protection legislation.

You may withdraw by:

  • Sending us a clear written notice before the withdrawal period expires;
  • Providing sufficient information to identify your claim.

Flyjustice will acknowledge receipt of your withdrawal request and process it in accordance with applicable law and these Terms.

12. Suspension & Termination

Flyjustice may suspend, decline or terminate its services where continuing to manage a claim is no longer reasonably possible or appropriate.

This may include circumstances where:

  • the claim falls outside our service scope;
  • insufficient evidence is available;
  • fraudulent, misleading or falsified information is identified;
  • duplicate representation or conflicting authority exists;
  • the airline has entered insolvency proceedings;
  • continuing the claim would be unlawful or have no reasonable prospect of success.

Where reasonably practicable, Flyjustice will notify you before terminating its services and explain the reasons for its decision. If you have any questions regarding the termination of your claim or any applicable Service Fees, please Contact Us for further assistance.

Unless otherwise agreed, termination of our services does not prevent you from pursuing your claim independently or appointing another authorised representative where permitted by law.

Termination of this agreement does not affect any rights, obligations or Service Fees that accrued before termination became effective.

Suspension or termination may occur if:

  • eligibility requirements are not satisfied;
  • fraud or abuse is identified;
  • legal or regulatory restrictions apply;
  • duplicate representation exists;
  • continued representation is no longer reasonably possible.

13. Privacy & Confidentiality

Flyjustice respects your privacy and is committed to protecting your personal data in accordance with applicable data protection laws. Personal information collected during the management of your claim is processed only for legitimate business purposes, contractual obligations, legal compliance, fraud prevention, and the protection of our legal rights.

Both you and Flyjustice agree to treat information exchanged during the management of your claim as confidential where appropriate, unless disclosure is required by law, regulatory authorities, judicial proceedings, or is necessary for the successful handling of your claim.

By using our services, you acknowledge that your personal data may be shared with airlines, competent authorities, payment providers, authorised legal partners, courts, insurers, or other third parties where reasonably necessary for the performance of this agreement or to comply with applicable legal obligations.

Confidentiality includes:

  • protecting personal information submitted during your claim;
  • limiting data sharing to authorised recipients;
  • complying with applicable data protection legislation;
  • protecting confidential business information where appropriate.

14. Liability

Flyjustice will perform its services with reasonable care, skill and diligence in accordance with applicable laws. However, we cannot guarantee that every claim will be successful or that compensation will always be recovered.

Nothing in these Terms limits or excludes liability where such limitation is prohibited by applicable law, including liability arising from fraud, wilful misconduct, gross negligence, death, personal injury, or any rights that cannot legally be excluded. These provisions shall be interpreted consistently with applicable consumer protection legislation, including Directive 93/13/EEC on Unfair Terms in Consumer Contracts, where relevant.

To the maximum extent permitted by law, Flyjustice shall not be liable for delays, losses or failures caused by airlines, airports, government authorities or other third parties outside our reasonable control.

Liability principles

  • Services are provided with reasonable care and skill.
  • Compensation recovery cannot be guaranteed.
  • Mandatory consumer rights remain unaffected.
  • Liability cannot be excluded where prohibited by law.

15. Force Majeure

Flyjustice shall not be responsible for delays or failures in performing its obligations where such events are beyond our reasonable control. This includes natural disasters, war, cyber incidents, government restrictions, widespread network failures, industrial action affecting our operations, or other unforeseen events.

This clause applies only to Flyjustice's performance and does not determine whether an airline may rely on extraordinary circumstances under passenger rights legislation.

  • Natural disasters
  • Government restrictions
  • Cybersecurity incidents
  • Widespread technical failures
  • Events beyond our reasonable control

16. Complaints & Dispute Resolution

If you are dissatisfied with our services, we encourage you to Contact Us so we can attempt to resolve your complaint promptly and fairly.

If a complaint cannot be resolved internally, you may have the right to refer the matter to an appropriate consumer dispute resolution body where available under Directive 2013/11/EU, without affecting your statutory rights.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Estonia. However, nothing in these Terms limits any mandatory consumer rights or legal protections available under the laws of your country of residence where such protections cannot legally be excluded, in accordance with Article 6 of Regulation (EC) No. 593/2008 (Rome I Regulation).

Any dispute shall be resolved by the competent courts having jurisdiction under applicable law. Nothing in these Terms restricts the jurisdiction rights granted to consumers under Regulation (EU) No. 1215/2012 (Brussels I bis).

  • Jurisdiction is determined by applicable law.

18. Changes to These Terms

Flyjustice may update these Terms from time to time to reflect changes in legislation, our services or business operations. The latest version will always be published on our website with the revised version number and effective date.

Unless required by law, changes will apply only from their effective date and will not affect agreements accepted under an earlier version.

19. General Provisions

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions shall continue in full force and effect.

Failure by Flyjustice to enforce any provision of these Terms shall not constitute a waiver of any right or remedy available under applicable law.

These Terms constitute the entire agreement between you and Flyjustice regarding the services provided through our platform and supersede any previous understandings relating to the same subject matter.

Flyjustice may transfer its rights and obligations under these Terms as part of a merger, acquisition or business transfer. You may not assign or transfer your rights or obligations without our prior written consent.

These Terms are prepared in English. Where translations are provided, the English version shall prevail to the extent permitted by applicable law.
